FEDERAL IMMIGRATION LAW: WHEN IMMIGRATION ISSUES ESCALATE

The federal immigration law comprises a substantial part of the US legal system. In order for immigration regulations and sanctions to be implemented on individuals who wish to immigrate into the US, the federal immigration law must be first enacted. The problems of illegal immigration and the causes of concern connected to it like population growth, the undermining of national security and substantial costs has led to the federal regulations regarding immigration.

Population Quota

The dramatic population growth brought about by illegal immigration, one that overwhelms communities across America -- crowding school classrooms, consuming already limited affordable housing and the increasing strain on natural resources like water, energy and forestland has spawned federal laws with the aim to control the number of individuals who will be allowed to emigrate into the US.

This is normally enforced everytime a new immigration reform comes up and it usually varies depending on the immigration status that is being applied for by the immigrants.

For example, for immigrants who wish to find work and are being sponsored, they have to join a delegated group of applicants which make up a certain percentage of the quota. Once the quota is fulfilled, the government is not able to make any more allowances and cases requiring more are usually handed over to immigration courts to determine or decide on.

The Green Card

The Green Card is a popular name given to the US Permanent Resident Card. Foreigners who hold such an identification card are legal residents of the US and eligible for employment. The term of the card is 10 years, is renewable and is issued by the Citizenship and Immigration Services, part of the Department of Homeland Security.

The green card contains a photo and fingerprint. Once-upon-a-time the card was green, but today it looks something like a driver's license. It is different from getting a visa which is temporary while a green card signals permanency.

There are a lot of reasons why immigrants will want or want a green card. Applying for a green card can at most, time consuming and complicated with a lot of prerequisites and requirements to fulfill before you can actually get approved. To apply for a Green Card, you must have a permanent employment opportunity in the US and must go through a multi-step process.

However, the government has created what is called the USA Green Card Lottery which is an opportunity for potential immigrants to obtain the status as a permanent legal resident of the USA. This program runs each year and provides 50,000 "Green Cards" to applicants randomly selected in a lottery selection process.

If a Green Card has been held for over 5 years, it is possible to go through the steps to acquire naturalization and eventually, US citizenship.

Determining The Best Status

Applying for the immigration status one wishes for can be affected by several factors. For example, an individual who may want to work in the US and applies for a work visa may get denied due to their inability to meet the requirements and prerequisites for such a status so they alternatively, can just decide to just apply for residency instead of employment.

Again, this is a situation where the federal laws set are enforced as the government decides up to what level individuals can reach in their immigration status application to control the number of individuals who can enter the USA.

While many immigrants still continue to try and gain entry into the US, the government's federal immigration laws will also continue to insure a tight control and regulation upon their number to reduce the instances of illegal immigration.
