IMMIGRATION FORMS TO FILL OUT FOR YOUR IMMIGRATION APPLICATION

Immigration is already a very complex topic by itself not only for the government but also for the immigrants applying for residency status. Since it is impossible to group all the applicants under just one category, the government has created several categories in order to correctly categorize the immigrants that come into the country.

When applying for residency into a particular country, it is very important to remember that there are certain criteria that must be met depending on what type of immigration status you are applying for in order for your application for immigration status to be successful. Immigrants may apply for one type of immigration status only -- fiance/spouse status, student status, temporary visitor for business, long-term employment or citizenship. Each type has specific prerequisites that must be met and fulfilled.

Since it can be difficult to determine and apply for any particular status, you must be able to acquire all the necessary immigration forms you will need to be sure about what choice you will make. It also helps to be more than substantially knowledgeable about the immigration process itself so you can make better decisions if you want to spend your future in a new country.

Different Strokes for Different Folks

The application process and requirements vary for each status. For example a fiance/spouse status will require a non-citizen who plans to marry a US citizen, he or she will need to complete a Petition for Alien Relative (for spouses) or a Petition for Alien Fiancé(e). After a visa is issued, the non-citizen's immigration status will be spouse or fiancé(e) of an American citizen.

A student migration status on the other hand requires a student visa which takes 6-8 weeks to obtain and requires that the applicant must be able to adequately speak, read, write and understand English, maintain his finances throughout his study and has been admitted into an academic program. Also, once a foreign student is granted student immigration status, he can remain in the United States for as long as he is enrolled in an academic program or is completing research for post-doctoral work.

However, one thing generally remains the same and that is the fact that applications for a particular status take a really long time to be accepted or rejected, the latter happening due to the applicant's inability to meet the requirements for the status they are applying for. But then again, it can also be because of circumstances beyond the applicant's control like for instance, they are in excess of the quota set for the applicants in their category.

Seeking Legal Advice

Because of the numerous immigration forms that need to be filled out, it is important that the immigrant seeks legal help and advice of an immigration attorney or any professional well-versed in immigration laws. It is always easier to make sound decisions if you have enough resources at hand. Also, seeking legal advice would help an applicant to understand the requirements and prerequisites needed for a successful application.
