THE IMPORTANCE OF KNOWING WHAT YOUR IMMIGRATION RIGHTS ARE

Immigration consists of many rules and regulations that not only determine whether or not an immigrant can or cannot be granted residency status but also to protect them and uphold their immigration rights as well whether or not their application is successful.

Immigration rights vary from country to country. The United Nations for instance, upholds certain human, immigrant and refugee rights that are strictly observed among each member country. Immigrant rights basically center on racial justice, economic equality and human dignity.

Knowing and understanding immigration rights not only makes it easy for legal immigrants to move between countries but also gives them the freedom of expression which above all else is a basic human right. However, there is still the need to exercise these rights prudently and it is important to remember that while immigrants do have rights, immigration into a country still has rules and regulations that they need to abide to, regardless.

The only exception to this would be refugees who have different rights than immigrants. This is because refugees who immigrate have the choice made for them due to reasons of war or persecution to save their lives. Though like an immigrant who will require a place to live, a refugee will more likely get their own place to live quicker than an immigrant applying for residency status.

An immigrant's right to trial also come to play when an immigrant has to appear before the immigrant courts. As with the native-born citizens, they also deserve to be represented in court by a competent immigrations lawyer and a right to fair trial.

These days however, there is a need to create new strategies that address the current context and which work towards long-term goals, such as creating immigration policies that uphold the civil and human rights of all immigrants, regardless of status.

The reason seems to stem from incidents that seemingly demonstrate an anti-immigrant stand like the implementation of the Arizona immigration law which has been put on hold to reduce the rising incidents of protests happening around the country which has become a political issue taken up by anti-immigrant groups, employers hungry for profits, and high profile political figures.

Preparing for this newest struggle, immigrant rights activists anticipated strong and well-funded opposition from the anti-immigrant movement, which was expected to invest hundreds of thousands of dollars in media campaigns to influence public opinion. Issues of this magnitude can severely affect the chances of immigrants still in the process of applying for their residency status.

The impact of the anti-immigrant right on the current immigration debate cannot be overemphasized and in fact, up to this point the immigration debate has largely been shaped by the anti-immigrant movement. Relying on a number of appealing and exclusionary arguments, the anti-immigrant right has tapped into the public imagination in a way immigrant rights activists have yet to match.

Because of this, discussions around immigration have centered around the themes of race relations and conflict, economic displacement, environmental destruction and over-population, urban sprawl, and crime.

It is important to look at both sides of the story and be objective about immigration rights as these incidents have the potential to escalate and become ugly. Immigrants, people of color, and working-class people together form a majority in the United States and thus as a people have the power to change both popular opinion and public policy.

If we can frame immigrant rights as an issue about human dignity, economic parity, and racial justice, then we can begin to lay the groundwork for transforming the immigration debate. Regardless of the situation, basic human rights must still be respected and observed.
